Terms and Conditions

Applicable to all Clients using the BandaBets website and mobile applications in Kenya.

1.Introduction

  • These Terms and Conditions (“Terms”), together with all documents referred to herein (including but not limited to the Privacy Policy, Cookies Policy, Sports Betting Rules, Casino/Live Casino Rules, Virtual Games Rules, and any specific promotional terms), constitute a legally binding contract between you (“Client”, “you”, “your”) and Bandabets in Kenya operated by Kenya Charity Sweepstakes, and is fully authorized and regulated by the Betting Control and Licensing Board (BCLB) under the Betting, Lotteries and Gaming Act, Cap 131, Laws of Kenya, with License Number: BK 0001329
  • By registering, accessing, or using our website (including all sub-domains), mobile applications, or any of our services (collectively the “Website” and “Services”), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.
  • Use of the Services is strictly limited to persons who are 18 years of age or older and who reside in Kenya where online betting is legally permitted.

2.Definitions

  • “Client”, “you”, “your”: the individual natural person registered with the Company.
  • “Prohibited Activity”: any activity listed in clause 6.
  • “PSP”: third-party payment service provider.
  • “Regulator”: Betting Control and Licensing Board (BCLB)
  • “Services”: all games of chance and betting products offered on the Website (sports betting, casino, live casino, virtual games, etc.).
  • “Sportsperson”: athletes, coaches, referees, team staff, or anyone who can influence the outcome of a sporting event.

3.Amendments to the Terms

  • We may amend these Terms at any time. Major changes will be notified via the Website and/or other communication channels. Minor changes take effect immediately upon publication.
  • Continued use of the Services after any amendment constitutes acceptance of the updated Terms.

4.Client Eligibility and Warranties

By registering and using the Services you warrant that:

  • You are 18 years or older and of full legal capacity.
  • All information and documents provided are true, accurate, and complete.
  • You are not self-excluded or prohibited from gambling.
  • All funds deposited originate from legitimate sources and belong to you.
  • You are not using any payment method that is not registered in your own name.
  • You accept full responsibility for any losses incurred and acknowledge that gambling carries financial risk.

5.Account Registration and Management

  • Only one account per person/telephone number is permitted. Multiple accounts will be closed.
  • You are solely responsible for maintaining the confidentiality of your login details. Any activity under your credentials is your responsibility.
  • You may request temporary suspension or permanent closure of your account at any time via Customer Support.
  • You must immediately notify us of any changes to your personal or payment details.

6.Prohibited Activities

The following (non-exhaustive list) are strictly prohibited:

  • Use of bots, artificial intelligence, scripts, or any automated betting software.
  • Collusion, match-fixing, cheating, or any attempt to manipulate outcomes.
  • Use of VPNs or any method to conceal your location or bypass restrictions.
  • Deposits or withdrawals using third-party, business, stolen, or unauthorised payment methods.
  • Bonus or promotion abuse.
  • Fraudulent activity, money laundering, or use of criminal proceeds.
  • Abusive behavior toward staff or other clients.
  • Any breach of Kenyan laws or BCLB regulations, including betting by Sportspersons on events in which they participate. Breach of this clause may result in immediate account closure, forfeiture of funds/winnings, and reporting to the authorities.

7.Account Suspension, Restriction, and Closure

  • We reserve the right, at our sole discretion and without prior notice, to refuse registration, suspend, restrict, or permanently close any account, especially in cases of suspected Prohibited Activity, fraud, bonus abuse, or regulatory requirements.
  • Upon closure for breach of these Terms, any remaining balance may be forfeited.
  • Dormant accounts (12 consecutive months of inactivity) may incur administration fees or be closed, with reasonable efforts made to return any balance.

8.Deposits and Withdrawals

  • Deposits and withdrawals must be made using payment methods offered on the Website and registered in your own name.
  • Withdrawals will only be processed to the same method/source used for deposit (where possible).
  • We may require identity processing any transaction.
  • No interest is paid on account balances. Betting on credit is prohibited.
  • Maximum Sportsbook and Casino winning per day is KES 1,000,000.

9.Betting Rules and Bet Acceptance

  • Bets are only valid once confirmed with a numbered bet slip.
  • Once confirmed, bets cannot be cancelled or modified by the Client.
  • We reserve the right, at our sole discretion, to withhold, void, or reclaim any winnings, bonuses, or payouts resulting from any game, feature, system, or promotion that is affected by technical errors, system malfunctions, software bugs, connectivity issues, or any other unforeseen technical failure. In such circumstances, all affected bets, rounds, or transactions may be declared void, and the Company shall not be liable for any losses or damages arising from such technical issues.
  • In case of discrepancy, our server logs are definitive.

10.Bonuses and Promotions

  • All bonuses and promotions are subject to specific terms, wagering requirements, and expiry dates.
  • We may exclude any client from bonuses or withdraw any promotion at any time without notice.

11.Responsible Gambling

  • We promote responsible gambling and provide tools such as deposit limits, loss limits, wager limits, time-outs, and self-exclusion.

12.Errors, Malfunctions, and Force Majeure

  • We reserve the right to correct obvious errors, void bets affected by technical malfunctions, and recover any funds paid in error.
  • We are not liable for interruptions, delays, or losses caused by events beyond our control (force majeure).

13.Intellectual Property

  • All content, trademarks, software, and materials on the Website remain our property or that of our licensors and may not be copied, reproduced, or used commercially without written permission.

14.Privacy and Data Protection

  • Your personal data will be processed in accordance with our Privacy Policy and applicable data-protection laws.

15.Complaints and Disputes

  • Complaints must first be lodged with Customer Support.
  • Unresolved disputes may be escalated to the BCLB or the courts of Kenya, which have exclusive jurisdiction

16.Limitation of Liability

  • To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss, including loss of profits or winnings, arising from use of the Services.

17.Taxes

  • You are solely responsible for declaring and paying any taxes on winnings as required by Kenyan law. We will deduct any withholding tax required by law before crediting winnings.

18.Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Republic of Kenya. Any dispute shall be subject to the exclusive jurisdiction of the Kenyan courts.

19.Severability

  • If the Company elects not to enforce any provision of these Terms or any other provision published on the Website, such decision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
  • If any provision of these Terms is determined by any court or other competent administrative body to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
  • In such instances, the provision declared invalid or unenforceable shall be amended in accordance with the applicable law to reflect the Company’s original intent as closely as possible.

20.Assignment

  • These Terms are personal to you and may not be assigned or transferred to any third party without our prior written consent. The Company reserves the right to assign, transfer, or delegate any of its rights and obligations under these Terms to any third party, provided you are appropriately notified in advance of such assignment, transfer or delegation, and that you are given a reasonable period to either accept to remain under the contract with the third party or to exercise your right to terminate the contract.

21.Marketing & Communications Consent

By registering an account with us and providing your personal details, you expressly consent to Bandabets / Banda Holdings collecting, storing, processing, and using your information for purposes related to the provision of our services, including marketing and customer communications.

This may include communication via, but not limited to:

  • SMS / text messages
  • Phone calls
  • Email
  • Push notifications
  • In-app messages
  • Any contact details provided during registration or KYC verification

Such communications may include information about promotions, bonuses, product updates, responsible gaming messages, and other service-related notices.

You acknowledge that your consent is given voluntarily and may be withdrawn at any time by updating your communication preferences within your account or by contacting customer support. Withdrawal of consent may limit your access to certain offers or communications but will not affect your ability to use the core services, subject to regulatory requirements.
